I have some software (and a few hardware pieces) that I need to sell but I'm not sure if they can be re-sold.
MOTU Digital Performer 5
MOTU Symphonic Instrument
Spectrasonics Stylus RMX
These are the software based items I'm needing to get rid of, but other than Stylus (which I believe I would need to purchase a license transfer) I can't figure out whether or not the MOTU stuff could be put on eBay.

your best bet would be to email MOTU support and ask them - Either that or you could look through the EULA (when you launch the installer) - it should be in there.

The only thing that would be illegal is if you made a bunch of copies and sold those.

Technically not always (at least according to the EULA). A lot of EULAs prohibit license transfers. Most of the time, those EULAs aren't truly legally binding if parts of them violate the laws of the particular state in which the user lives, but if you buy a second hand piece of software that prohibits license transfer and have a problem (like if the key doesn't work because it's already been registered), you're SOL because the Software maker will tell you to go piss up a rope if you call them for support.
Microsoft licensing is a perfect example of this.
Your best bet is to contact the mfg and ask them what their license transfer process (if any) is.

Well it sounds fair enough, but that's not the case for many software companies. The problem is in the license transfer. Unless the buyer is not interested in getting new updates or bug fixes, highly unlikely of course.
There is a white list at KVR of the companies that do allow for license transfer, Native Instrument allow it for a fee. Cakewalk on the other hand is one of the companies that do NOT allow any licence transfers.
